This class action lawsuit is going forward in the Pennsylvania Common Pleas Court in Harrisburg, PA. The lawsuit seeks to recover unpaid overtime wages for homecare workers employed by Alma Health, LLC, which is commonly known as “MedStaffers.” The workers allege that MedStaffers violated Pennsylvania overtime law by failing to pay them extra overtime compensation for hours worked over 40 per week week. MedStaffers denies violating any laws.

APR 20, 2015

Today, our firm started this lawsuit by filing a Complaint in the Common Please Court in Harrisburg, PA. The Complaint alleges that MedStaffers violated the Pennsylvania wage law by failing to pay home health workers adequate overtime compensation for hours worked over 40 per week. APR 17, 2015

Today, MedStaffers filed an Answer in which it denies violating any laws. You can access the Answer below.


MAY 13, 2016

Today, our firm filed a motion seeking "class certification" of this lawsuit. The motion asks that the Judge to allow the lawsuit to go forward on behalf of the following "class" of workers: “All persons who worked for Defendant and were paid under its “Live-in Rate” system during any workweek since February 18, 2012.” The class certification motion papers are available below.


OCT 18, 2016

We are very pleased that, earlier today, the Judge granted the class certification motion. Now, the lawsuit can go forward on behalf of all MedStaffers employees paid under the “Live-in Rate” system since February 18, 2012. The class certification Order is available below.


FEB 7, 2017

Today, a Court-approved "Notice Form" was mailed to over 120 workers covered by the lawsuit. The Notice tells workers about the legal claims and explains what steps a worker if she does not want to be included in the lawsuit. A copy of the Notice Form is available below.


OCT 19, 2017

We have been making progress on this case and have obtained payroll data and records for the class members. We currently are engaged in the "discovery" phase of the case. During this phase, the competing parties are able to obtain documents and information from one another.


FEB 12, 2018

On February 2, 2018 the Dauphin County Court of Common Pleas Court Judge overseeing this matter held a scheduling conference with the attorneys for both parties in this case. At the conclusion of the conference, Judge Andrew Dowling put together a schedule for the remainder of this litigation which is memorialized in the February 7, 2018 order posted below. JUL 13, 2018

Today we filed a Motion for Summary Judgment asking the Court to enter an order finding in favor of the Plaintiff and the Class on our calculation of wages. Defendant's response to this motion is due on August 13, 2018. Our hope is that the Court will rule on this motion in the next few months. MAY 6, 2019

We are happy to announce that today the Dauphin County Court of Common Pleas Court judge assigned to this case granted our motion for preliminary approval of the class action settlement of this case. The Court ordered that notice of the settlement be sent to members of the class and scheduled a final approval hearing for July 22, 2019. You can access a copy of the Court’s order below.
