This collective action lawsuit is going forward in the District Court for the Eastern District of Pennsylvania. The lawsuit seeks to recover unpaid overtime wages for CHC Service Coordinators employed in Pennsylvania by AmeriHealth Caritas. The workers allege that AmeriHealth Caritas violated Pennsylvania and federal law by failing to pay them full overtime premium compensation for hours worked over 40 per week. AmeriHealth Caritas denies that it violated any laws.

Today, AmeriHealth Caritas filed papers seeking to "remove" this lawsuit from the Philadelphia Court of Common Pleas to the United States District Court in Philadelphia, PA. Copies of the removal papers are available below.

We have decided that we are not going to challenge AmeriHealth Caritas' removal of this lawsuit to the United States District Court. So this lawsuit will go forward in the District Court and has been assigned to Judge Wendy Beetlestone.

Today, AmeriHealth Caritas filed its Answer to the Amended Complaint. A copy of the Answer is available below. As indicated, the company alleges, among other things, that CHC Service Coordinators are "exempt" from the federal and state overtime laws. In other words, the company alleges that its non-payment of overtime wages is legally correct and that it has not violated federal or state wage laws.

Today, the Federal Judge entered a stipulated Order "conditionally certifying" this lawsuit as a "collective action." As a result of this Order, current and former CHC Service Coordinators will be mailed a "Notice Form" describing the lawsuit and a "Consent Form" that can be used to join the lawsuit.

Today, a third-party administrator mailed the Court-approved "Notice Form" and "Consent Form" to the last-known address of all individuals who worked as CHC Service Coordinators during any time since April 1, 2019. The Notice Form describes the lawsuit, while the Consent Form must be completed and returned by any individuals who wish to join the lawsuit. If you worked as a CHC Service Coordinator after April 1, 2019 and have not received the Notice and Consent Forms (because, for example, you recently moved), you should call us at (215) 884-2491. We will ask the third-party administrator to re-mail the materials to you. The deadline for individuals to join the lawsuit is May 6, 2022.

We are very pleased to report that, as of today, 138 current and former CHC Service Coordinators have joined this lawsuit by returning "Consent Forms." The deadline for individuals to join the lawsuit is May 6, 2022.

We are very pleased to report that, as of today, 200 current and former CHC Service Coordinators have joined this lawsuit by returning "Consent Forms." Currently, we are working on a plan for completing "discovery," which is the phase of litigation where the parties exchange information and documents.
