This lawsuit seeks to recover unpaid minimum wage and overtime compensation for production employees who worked for Perfection Foods Company, Inc at its Old York Road facility in Philadelphia, Pennsylvania. The production employees allege Perfection Foods Company, Inc. violated federal and state wage laws by failing to pay them the mandated minimum wage and overtime premium compensation.

Today, our firm, along with Community Legal Services of Philadelphia, filed a class and collective action lawsuit against Perfection Foods Company, Inc. and other co-defendants in the United States District Court for the Eastern District of Pennsylvania on behalf of production employees who worked at the Perfection Foods Facility located on Old York Road in Philadelphia Pennsylvania. The lawsuit alleges that Perfection Foods and the other co-defendants violated federal and Pennsylvania law by requiring that production employees work “off-the-clock” and failed to pay them time and one-half pay when they worked over 40 hours in a week. Today, we are pleased to announce that Judge Berle Schiller of the Eastern District of Pennsylvania conditionally certified a collective under the FLSA pursuant to 29 U.S.C. § 216(b). In accordance with the Court’s ruling, notice will be mailed out in the coming weeks to “All individuals who during any workweek since February 22, 2013 worked for Maximum Labor, Inc. and were assigned to work at the Perfection Foods Company, Inc. facility located at 3901 Old York Road, Philadelphia, PA..” You can access a copy of the Court’s order below.

Today, the Federal Court issued an order assigning this lawsuit to a settlement conference before a Magistrate Judge. The settlement conference will take place on May 10, 2017. A copy of the Order is available below.

Today, the Federal Magistrate Judge presided over a settlement conference. After hours of negotiations, the parties were able to reach a settlement to resolve this lawsuit on behalf of the 20 individuals who are covered by the case. The parties will spend the next several weeks finalizing the settlement documents and ultimately filing a motion asking the Judge to approval the settlement as fair and reasonable.
