New Jersey Federal Court Holds that New Jersey Wage and Hour Law Provides a Private Right of Action for Overtime Claims

In an important case of first impression, Judge Kevin McNulty recently issued a thoughtful opinion explaining that the New Jersey Wage and Hour Law (“NJWHL”) allows New Jersey employees to bring private lawsuits seeking unpaid overtime pay.  The case is entitled Thompson v. Real Estate Mortgage Network, Inc., 2:11-cv-01494 (D.N.J.).  In the May 22, 2015 opinion, the court rejects the argument that the NJWHL’s statutory provision allowing workers to bring a private right of action is strictly limited to minimum wage — but not overtime — claims.  Here is a link to the decision:  Decision-Thompson v.
