Winebrake & Santillo Obtains Judgment on Behalf of Over 400 Servers Following Jury Trial Win

On September 16, 2024, the Western District of Pennsylvania entered a judgment totaling $861,388.62 in favor of over 400 servers at Kings Family Restaurant represented by Winebrake & Santillo.  The judgment followed the October 2023 jury verdict in their favor after a five-day trial.  The judgment consists of $250,000.00 in unpaid wages, an additional $159,330.61 in liquidated damages, plus $452,058.01 in attorney’s fees and costs.  The trial team at Winebrake & Santillo consisted of attorneys Andy Santillo, Mark Gottesfeld, and Michelle Tolodziecki.

An article in Law360 discussing the decision is available here.  Attorney Santillo was quoted as follows:  “We are very pleased with the Court’s order today and its decision this past June to add liquidated damages to the jury’s original verdict in our clients’ favor.  Darlene McDonnell and the other servers in this case worked hard at Kings Family Restaurants.  We are happy that we were able to help them obtain a judgment for the wages that they should have been paid in the first place.”
