MAR 28, 2017

Today, our firm filed a class and collective action lawsuit in the United States District Court of New Jersey on behalf of drivers for AllPoints Courier Services, Inc. who deliver packages for Amazon.com. The lawsuit alleges that AllPoints violated the Fair Labor Standards Act and the New Jersey Wage and Hour Law by failing to pay its drivers for all time worked. In particular, for time at the beginning and end of each day before and after they clock-in/clock-out at the Amazon warehouse. The lawsuit seeks to proceed as a collective action under federal law and a class action under New Jersey state law. You can access a copy of the Complaint below. AUG 23, 2017

Today AllPoints filed an Answer to the Complaint in which it generally denied violating the law and asserted that their pay practices are legal. A copy of this document is below.


OCT 3, 2017

Today we participated in an initial scheduling conference before before Magistrate Judge Ann Marie Donio of the United States District Court for the District of New Jersey. Judge Donio scheduled a follow-up conference with the parties for January 8, 2018.


NOV 16, 2017

Today District Judge Jerome B. Simandle issued an order conditionally certifying this case as a collective action under the Fair Labor Standards Act. In early December, those individuals who worked as drivers for AllPoints within the past three years will be mailed a notice and consent form which gives them the opportunity to join or "opt-in" to this litigation. A copy of the Court's order is below.


JAN 8, 2018

Today we participated in a telephone status conference before with Magistrate Judge Ann Marie Donio of the United States District Court for the District of New Jersey. Judge Donio scheduled a follow-up conference with the parties for February 26, 2018.


JAN 19, 2018

The period of time for individuals to join this case has now closed. We are very pleased to report that as of today a total of 46 delivery drivers have joined this case.


FEB 26, 2018

Today we participated in a telephone status conference before with Magistrate Judge Ann Marie Donio of the United States District Court for the District of New Jersey. Judge Donio scheduled a follow-up conference with the parties for March 28, 2018.

JUL 13, 2018
