Today, our firm started this class/collective action lawsuit by filing a Complaint with the United States District Court for the Middle District of Pennsylvania. The lawsuit is brought on behalf of individuals who performed work on oil and gas rigs in Pennsylvania and beyond. The lawsuit alleges that Defendant Cenergy International Services, LLC (“Defendant”) paid these individuals on a day-rate basis and failed to pay extra overtime compensation when the employees worked over 40 hours per week. The lawsuit alleges that this practice violates the federal Fair Labor Standards Act (“FLSA”) and the Pennsylvania Minimum Wage Act (“PMWA”). You can access the Complaint below. Today, the Defendant filed an Answer to the Complaint. In the Answer, Defendant denies violating the law and asserts that its pay practices are legal. In addition, the Defendant filed a motion to transfer this case to the United States District Court for the Southern District of Texas. Today we filed a notice with the Court stating that we do not oppose the Defendant’s motion to transfer this case to the United States District Court for the Southern District of Texas. A copy of this filing is available below. Once the case is transferred, it is anticipated that it will be consolidated with a similar case titled Derrick v. Cenergy International Services, LLC, No. 16-cv-1352 (S.D. Tex.).

Today the United States District Court for the Southern District of Texas issued a scheduling order establishing initial deadlines for this case. The Court set a deadline of May 1, 2017 for completing all discovery related to this case. A copy of this scheduling order is below.
