This lawsuit seeks to recover unpaid overtime compensation for Satellite TV Installation Technicians who worked for DIRECTV, LLC and MasTec North America, Inc.. The technicians allege that DIRECTV/MasTec violated federal and Pennsylvania law by misclassifying them as “independent contractors” and failed to pay them minimum wage as well as overtime premium compensation for all hours worked over 40 in a week.

Today, our firm, along with co-counsel Stueve Siegel Hanson LLP and Lear Werts LLP, started this lawsuit by filing a Complaint in the United States District Court for the Middle District of Pennsylvania against DIRECTV, Inc. and Mastec North America, Inc. The lawsuit is brought on behalf of four Satellite TV Installation Technicians and alleges that DIRECTV/Mastec classified these individuals as independent contractors and failed to pay minimum wage and overtime premium compensation as required under federal and Pennsylvania law. Today we are pleased to announce that the Honorable Robert Mariani of the Middle District of Pennsylvania issued an order denying DIRECTV/Mastec’s motion to dismiss the case of the four Satellite TV Installation Technicians represented by our firm and co-counsel. A copy of Judge Mariani’s opinion is below. The parties will now begin the discovery phase of the lawsuit.

Today DIRECTV/Mastec each filed an Answer to the Amended Complaint in which it generally denied violating the law and asserted that their pay practices are legal.

Nov 28, 2016

Today DIRECTV/Mastec filed a motion for summary judgment in this case asking the Court to find in their favor as a matter of law and dismiss the case without needing to go to trial. The plaintiffs will be filing an opposition to this summary judgment motion in the coming weeks.
