Flower's Foods

Our firm, working with various co-counsel, represent distributors who worked for Flowers Foods, Inc. and Flowers Baking Co. of Oxford, Inc. (“Flowers”). These distributors deliver Flowers' bakery products (such as Nature's Own and Wonder brand breads) to grocery stores and other customers and perform basic merchandising activities (such as stocking shelves) in the stores. Flowers classifies these distributors as independent contractors instead of employees.

The lawsuit challenges this classification and alleges that the distributors deserve the benefits and protections available to employees under the federal Fair Labor Standards Act ("FLSA") and the wage laws of Pennsylvania, New Jersey, Delaware, and Maryland. We hope to recover on behalf of the distributors extra overtime pay for hours worked over 40 per week and the reimbursement of various types of deductions, charges, and out-of-pocket expenses incurred by the distributors. Flowers denies liability, and the Judge has not decided who will win.

May 24, 2016

Today, the case was transferred to the United States District Court in Philadelphia, PA so that it can be litigated alongside a similar case asserting that Flowers violated the FLSA and various state wage laws. A copy of the transfer order can be found below.

We have now completed the discovery phase of this lawsuit. It is anticipated that the parties will be filing several motions with the Court to determine if it can go forward to trial.
