This class action lawsuit seeks to recover unpaid overtime wages for workers at the longwall mining operation in Waynesburg, Pennsylvania (the “Cumberland Mine”). The lawsuit alleges that the company violated Pennsylvania wage and overtime law by failing to pay for certain work activities performed before and after their paid shift. These activities include, for example, time spent gathering and putting on and taking off certain personal protective equipment (“PPE”), obtaining batteries for their radios and cap lights, and walking to and from certain areas within the facility.
