In this class/collective lawsuit, our firm along with co-counsel Friedman & Ranzenhofer, P.C. and Lichten & Liss-Riordan, P.C., represents delivery drivers who were classified as independent contractors by the company. The lawsuit alleges that the delivery drivers were actually employees of Liberty and that due to this non-employee classification the company: (i) failed to pay drivers minimum wages in violation of the federal Fair Labor Standards Act (“FLSA”) and New York Labor Law ("NYLL") because it made large deductions to the drivers compensation that brought them below the $7.25 per hour minimum wage requirement; and (ii) made improper pay deductions to their compensation in violation of the NYLL.
