Today, our law firm filed a class action lawsuit against Sunny Days In Home Care, LLC, in the Washington County, PA Court of Common Pleas. The lawsuit alleges that Sunny Days violated the Pennsylvania Minimum Wage Act (PMWA) by failing to pay Caregivers overtime premium compensation for the hours worked over 40 in a workweek. Instead, it is alleged that Sunny Days only paid Caregivers their regular hourly rate for hours worked over 40. You can access a copy of the Complaint below. We are pleased to announce that we received an Order today from Judge Damon J. Faldowski dismissing Sunny Day’s preliminary objections. Sunny Day’s preliminary objections sought to dismiss the class action allegations asserted in this lawsuit. As a result, this class action lawsuit continues to assert claims on behalf of all Caregivers employed by Sunny Days since November 13, 2012. Pursuant to the Order, Sunny Days has twenty days to respond to the Complaint in this lawsuit. You can access a copy of the Court’s Order below.

We are pleased to announce that the Judge overseeing this lawsuit certified a class consisting of: All persons who were employed by Defendant Sunny Days Home Care LLC and received straight-time compensation for hours worked over 40 per week since November 13, 2012. A copy of the Court's order is available below. In the coming weeks, current and former home health workers employed by Sunny Days will be mailed a court-approved Notice Form. Today Judge Faldowski issued a scheduling order setting deadlines for the remainder of the litigation. All discovery will need to be completed by the end of October. At that time, it is expected that the Court will select a time for the trial of this case.

Today Judge Michael Lucas of the Court of Common Pleas of Washington County issued an order scheduling an in-person pre-trial conference in this case for Wednesday May 2, 2018. Today we participated in an in-person conference with Judge Michael Lucas of the Court of Common Pleas of Washington County. During this conference the parties were able to settle this case as a class action. If approved, the Court will authorize the mailing of a lengthy notice that will be sent to members of the certified class later this summer describing the terms of the settlement and the amounts of class member's individual recoveries. The notice will answer many (if not all) of the questions that class members who are covered by the settlement may have. If class members still have questions about the settlement later this summer after reading the court-approved notice, we would encourage you to call our office at that time to speak with one of our attorneys.

Today we filed a motion for preliminary approval of the class action settlement in the case. If the Court grants this motion, a notice will be mailed out informing class members of the terms of the settlement and providing the date and location of the final approval hearing.

Today we are pleased to announce that Judge Lucas granted our motion for preliminary approval of the settlement. A final approval hearing has been scheduled for October 11, 2018 in Washington, Pennsylvania. A copy of the Court's order is available below.

Today we are pleased to announce that Judge Lucas granted our motion for final approval of the class action settlement following the final approval hearing. The settlement only concerns unpaid overtime claims during the period from November 3, 2012 until December 5, 2015. A copy of the Court's order is available below.
