Today, our firm, along with co-counsel Werman Salas P.C., started this collective action lawsuit by filing a Complaint in the Federal Court in Chicago, IL. The lawsuit is brought on behalf of employees who worked as salaried retail managers at T-Mobile stores operated by Defendant TCC Wireless, LLC (“Defendant”). The lawsuit alleges that by paying retail store managers a salary and classifying them as exempt from overtime premium pay for hours worked over 40 in a week, Defendant violated the federal Fair Labor Standards Act (“FLSA”). Today we filed an Amended Complaint against Defendant TCC Wireless, LLC adding new claims under the Illinois Minimum Wage Law on behalf of salaried retail store managers who worked in Illinois. A copy of the Amended Complaint available is below.

Today the federal judge overseeing this lawsuit issued an order denying Defendant’s motion to transfer this case from the Northern District of Illinois to the District of New Jersey. A copy of the Court’s order is available below. As of today, eleven (11) salaried retail store managers have filed consent to join forms to participate in this case.

May 25, 2017

Today, our firm, along with co-counsel Werman Salas P.C., filed a motion for conditional certification with the United States District Court for the Northern District of Illinois asking that notice be sent to the following individuals pursuant to 29 U.S.C. § 216(b): All salaried Managers and Assistant Managers who worked at any of TCC Wireless, LLC’s T-Mobile retail stores in the prior three (3) years. Today, we are pleased to announce that Judge Ronald A. Guzman of the Northern District of Illinois granted our Motion for Conditional Certification. In accordance with the Court’s ruling, notice will be mailed out in the coming weeks to all salaried Managers and Assistant Managers who worked at any of TCC Wireless’ T-Mobile retail stores in the past three years so that they will have the opportunity to join the case. Today Judge Ronald A. Guzman of the Northern District of Illinois entered an order approving the form of the notice and consent forms that will be sent to all salaried Managers and Assistant Managers who worked at any of Defendant’s T-Mobile retail stores since July 12, 2014. You can access a copy of the Court’s order below as well as copies of the Notice Form about the lawsuit and the Consent to Join Form that was approved by the Court. The court-approved Notice and Consent to Join Forms will be mailed in the coming weeks. Individuals wishing to be covered by the lawsuit will ultimately need to complete, sign and return a Consent to Join Form.

We are very pleased to announce that as of today, a total of 184 current and former salaried TCC Wireless retail managers have joined this lawsuit. The deadline for individuals to complete and return Consent to Join Forms is October 12, 2017.

We are happy to announce that today Magistrate Judge Maria Valdez granted our motion for preliminary approval of the class and collective action settlement of this case on behalf of salaried managers at T-Mobile retail stores. The Court ordered that notice of the settlement be sent to members of the class and scheduled a final approval hearing for March 8, 2018. You can access a copy of the Court’s order below. The notice that will be sent to those individuals covered by the settlement is scheduled to be mailed the last week in December 2017.

Today the federal judge overseeing this lawsuit held a hearing on our motion for final approval of the settlement. We will update this website as soon as the Court issues a ruling.
