Warehouse Labor Violations
Philadelphia Warehouse Worker Rights Attorney
Advocating for Warehouse Worker Rights in Pennsylvania
Many warehouse employees are not paid for mandatory activities arising in the warehouse. This is generally illegal. Under Pennsylvania law, warehouse workers should be paid for activities such as:
- Security screenings
- Walking to and from assigned work locations
- COVID health screenings
- Picking up required gear
- And more.
At Winebrake & Santillo, we firmly believe that warehouse employees are entitled to all the protections provided under Pennsylvania law. If you suspect that your employer has violated your rights and federal or state labor laws, we encourage you to let us work with you to hold them accountable.

How Our Warehouse Workers Rights Attorneys Support You
Warehouse workers often feel powerless when their rights had been violated, especially when going up against large corporations or employers. At Winebrake & Santillo, we are here to level the playing field. We focus on providing comprehensive legal representation to warehouse workers in Philadelphia, ensuring their rights are protected. We can assist you by:
- Investigating Violations: One of the first steps we take is thoroughly investigating your claim. Whether it involves wage theft, unsafe conditions, or harassment, we gather and review the necessary evidence to build a strong case. This often includes reviewing your employment records, pay stubs, and any communications with your employer. We also consult with experts when needed to prove violations of labor laws.
- Filing Claims and Lawsuits: If your employer has violated your rights, we’ll guide you through the process of filing a claim. This could involve filing a complaint with the Department of Labor, OSHA, or pursuing a civil lawsuit. We handle every aspect of your case, from the initial complaint to negotiating settlements or representing you in court.
- Recovering Compensation: Warehouse workers who experience rights violations may be entitled to financial compensation. This can include back pay, unpaid overtime, damages for emotional despair, and penalties against the employer. We work to maximize your recovery, ensuring you receive the compensation you deserve.
- Protecting You from Retaliation: If you’re worried about retaliation from your employer, our attorneys will help safeguard your rights throughout the process. We’ll ensure that your employer is held accountable for any wrongful actions taken against you and help you navigate any employment issues that arise as a result of your claim.
Pennsylvania Warehouse Worker Case Study
We’ve represented warehouse workers against companies of all sizes, including some of the biggest businesses in the United States. For example, our firm has played a pivotal role in a lawsuit against Amazon on behalf of workers in their warehouse-fulfillment centers. These workers were required to undergo security screenings outside of normal work hours, which were often lengthy and included significant wait times. We argued that this was a violation of Pennsylvania’s Minimum Wage Act (PMWA), because these workers were unpaid for hours they were required to spend on warehouse facility premises.
In July 2021, the Pennsylvania Supreme Court issued an opinion agreeing with our assessment. It opined that under the PWMA, compensable working hours include the entire time an employee is required to be at the workplace, regardless of whether they are performing the outlined duties of their job.
